LAWSUITS

1. Woodmere Club vs. Town of Hempstead, 2017:  The Lawsuit filed claimed that the Town’s moratorium against all development at the Woodmere Club was illegal.

  • RESULT:  The State Judge ruled the Moratorium was illegal and    invalidated such moratorium.  The Town of Hempstead claimed that they would appeal but in fact they have not and the time period for appeal has passed.  Hempstead is barred from issuing a moratorium against the Woodmere Club.

2. Woodmere Club vs. Village of Woodsburgh, 2019:  The Lawsuit filed claimed that the Village of Woodsburgh moratorium against all development at the Woodmere Club was illegal.

  • RESULT:  Even before Woodsburgh answered our lawsuit, the Village sought to settle the claim.  The parties settled the claim with Woodsburgh agreeing to let the moratorium expire (which it has) and has agreed to not put in any further moratoriums.   

 3. Woodmere Club vs. Town of Hempstead, 2019:  The Lawsuit filed claimed that the Town was withholding information regarding the park district and other proposed zone changes from being released under the Freedom of Information Law (FOIL).

  • RESULT:  The court ruled that all information must be released to the Woodmere Club.  To date the Town of Hempstead continues to violate the Judge order and the Woodmere Club intends on seeking enforcement of the Judge’s Ruling.

4. Woodmere Club vs. Village of Woodsburgh, 2019:  The Lawsuit filed claimed that the recently passed Vision Plan was illegal.

  • RESULT:  The case was recently filed and the Village will have to explain how their Vision Plan is not illegal.
